A year probation was the sentence handed down Tuesday against a former Melcher-Dallas man found guilty of assaulting his then-girlfriend.

Last month, a Marion County jury found 36-year-old Dustan Eugene Holtry of Grand River guilty of Assault Causing Bodily Injury, a serious misdemeanor, while finding him not guilty on two other counts. In addition to probation, Holtry was also given a one-year suspended sentence and a $315 dollar fine.

According to court documents, the victim told police Holtry knocked her down, put his hands around her neck, and was impeding her breathing as she tried to call for help during an altercation on March 15th.

A check of Holtry’s criminal past shows a prior domestic assault charge in 2012.

Holtry missed his original sentencing date of November 12th and was arrested on a warrant later that day.
