The Central Iowa Water Association (CIWA) has given written notice that they will withdraw from the Attica-Pershing Wastewater project and terminate its 28E agreement with Marion County.

In a letter to Marion County Attorney Ed Bull, an attorney for the CIWA says that while the board of directors found this a difficult decision to make, the project suffered through countless delays including those resulting from a lawsuit filed by Cee Cee Farms to prevent access to their property. As a result, the CIWA feels “it no longer appears feasible for the project to be completed within the timelines required to receive the project funding.”

A public hearing regarding the acquisition of land for the project is scheduled for Tuesday. The hearing was expected to discuss the possibility of the county obtaining land through eminent domain.

Site evaluations for the land in question were provided to two residents in the area, including Ginger Harry, the owner of Cee Cee Farms, who’s opposed to the acquisition. She recently obtained a restraining order against the county to prevent any soil boring from being done on her land.

The Marion County Board of Supervisors is planning a response to this notice.
