The Court of Appeals of Iowa has upheld a ruling against a Marion County resident who was looking to obtain a permit to carry a concealed weapon.

Jeff Lebeck was denied the permit by the Marion County Sheriff’s Office in 2013 after it was discovered during a background check that he had a domestic assault charge on his record in 2010, disqualifying him from obtaining one. He would later plead guilty to a lesser charge.
Lebeck contends on appeal his right to due process was violated because there was not enough evidence to deny his request.
But the appeals court agreed with rulings by an administrative law judge and the district court that the sheriff’s office was well within their right to decline Lebeck’s request.
