
A Knoxville man has been arrested for alleged felony assault as an inmate in the Marion County Jail.
According to court records, on March 17th Marion County Jail Administrator Lieutenant Reed Kious served Inmate Jacob Shives his charges from two prior alleged offenses. Shives is accused of then spitting on Kious and then the documents. Kious observed the fluid to be reddish brown in color and believed Shives had spit bloody saliva on him. Kious attempted to view an injury in Shives’s mouth, but he did not allow Kious to view his mouth to confirm an injury.
Kious, was also observing and assisting jail staff with a meal pass to Shives in a booking cell. Shives was allowed one hand out to eat, and allegedly took his food and threw it. Shives then allegedly refused to put his hand back in the restraint chair. Kious then took control of Shives’s hand in which he allegedly repeatedly spit on Kious’s face while he regained control of his hand. Shives also allegedly refused orders to go into the restraint chair, actively resisting staff. During his resistance, Shives injured the hand of another jailer.
Shives was recently arrested on February 18th for Driving While Barred, criminal mischief and trespassing on February 24th, felony criminal mischief on March 5th, seven counts of failure to appear/contempt on March 8th, and then was arrested again on March 11th for Fourth Degree Criminal Mischief. Shives now faces additional charges of Assault by Inmate with Bodily Fluids, a Class D Felony, Assault on Persons in Certain Occupations, and Assault on Persons in Certain Occupations Causing Bodily Injury, which are both misdemeanors.
