A Newton man who was facing a felony theft charge for allegedly stealing $14,000 from a Newton woman has been ordered to pay the victim all that money back. David Matthew Sears was also given a suspended two year prison term, a suspended $855 fine, and two years of probation when he was sentenced in Jasper County District Court on Monday. The 43-year-old pleaded guilty to an aggravated misdemeanor forgery charge, while a class C felony 1st degree theft offense was dismissed. According to Newton Police, the victim gave Sears a check in August to purchase new windows for her home. Court documents state Sears provided her with a fake invoice, cashed the $14,000 check, and then didn’t respond to the woman when she inquired about when the windows would be delivered. District Court Judge Brad McCall handled Sears’ sentencing and signed the order requiring him to make full restitution to the victim.
