On Thursday, a Marion County Judge ruled to deny the motion of a summary judgement in the wrongful death lawsuit of Shirley Carter.

Late husband of Carter, Bill G. Carter, brought the lawsuit against his son Jason Carter, who he blames for the shooting death of his wife Shirley.

Steve Wandro, who represents the defendant Jason Carter, tells KNIA/KRLS News, “We are looking forward to going to trial and having Jason Carter vindicated by a jury. And so we are very much looking forward to it and Jason is very much looking forward to his day in court.”

Ron Danks, the attorney for Bill G. Carter tells KNIA/KRLS News “We are pleased to have won the summary judgment; we’re pleased to be going to trial to get to present our evidence there. But the summary judgement doesn’t count for anything once you get to trial. But I think that my clients are looking forward to getting the evidence out in front of a jury and letting the judiciary system work.”

To date, no arrests have been made in the homicide of Shirley Carter, who was shot and killed inside her home near Lacona on the morning of June 19th, 2015. With Thursday’s ruling, the civil case will now go to a jury trial on April 3rd.
